Former Cal/OSHA head discusses work safety initiative enforcement ...

In a previous post, our blog discussed a study by the Santa Monica-based RAND Corp., which determined that while the California Injury and Illness Prevention Program (CIIPP) has proven successful in reducing work injuries, accidents and hazards over the last 19 years, this success has been largely limited to those businesses that were cited for violating particular work safety mandates.

Specifically, RAND researchers found that inspectors with the California Division of Occupational Safety and Health (Cal/OSHA) -- the agency in charge of enforcing CIIPP -- are mainly checking to see if employers have the required written policy and often not delving any deeper. However, when they do delve deeper and cite an employer for violating a specific CIIPP violation, real change occurs.

For those unfamiliar with CIIPP, it is an occupational safety program introduced in 1991 to drastically reduce the number of work injuries/accidents here in the Golden State. It calls for employers to do some of the following:

  • Convey workplace risks to employees
  • Investigate work injuries
  • Implement safety training
  • Reduce/eliminate workplace risks
  • Execute workplace surveys
  • Create a written policy on workplace safety

Interestingly, Len Welsh, the Cal/OSHA chief from 2003 to 2011 and current chief counsel for the Department of Industrial Relations' litigation department, recently came out in defense of how agency inspectors have enforced CIIPP over the years.

Here, one of Welsh's primary arguments was that Cal/OSHA inspectors are rarely able to delve very deeply into all potential CIIPP violations because their ranks are simply spread too thin. (Specifically, government statistics there are only 240-some inspectors and 1.3 million businesses in California).

Accordingly, Welsh reasoned that the agency must instead focus its limited resources on cracking down on those business operators who "may wind up in jail when we catch them."

"We have to ask ourselves, 'Should we be spending half-a-day there to issue one or two tickets, or should we be moving in on and trying to nail somebody who is in the underground economy?'"

Welsh was generally supportive of the study, and believed that it not only presented CIIPP in a positive light but also raised some rather interesting manpower issues that will likely need to be addressed further down the road.

"[I]f you really implement an IIPP, you will see a benefit, but if you get it and stick it on a shelf, it's not going to do anything for you. To me the news is pretty much all good," he said. "[However,] if the proposition is that inspectors should dig deeper when they see no paper ... that's a resource question that needs to be studied."

BP hikes dividend after strong fourth quarter (AP)

LONDON ? BP PLC has raised its quarterly dividend by 14 percent after posting double-digit gains in profit and revenue in the last three months of 2011 despite further big payments to compensate for the disastrous oil spill in the Gulf of Mexico.

For the three months ending Dec. 31, BP reported a profit of $7.69 billion, up 38 percent from the $5.57 billion posted a year earlier. Revenue was up 15 percent at $96.3 billion.

Replacement cost profit, a closely watched industry measure, was 65 percent higher at $7.6 billion.

"2012 will be a year of increasing investment and milestones as we build on the foundations laid last year," said CEO Bob Dudley.

"As we move through 2013 and 2014, we expect financial momentum will build as we complete payments into the Gulf of Mexico Trust Fund, restore high-value production and bring new projects on stream."

The fund Dudley referred to is the Deepwater Horizon Oil Spill Trust, created in 2010 to pay victims of the spill. BP had paid $15.1 billion of the $20 billion it's supposed to put into the fund as of Dec. 31. The fund has paid out about $6.7 billion in claims.

For the full year, BP reported a profit of $39.8 billion compared to a loss of $3.7 billion in 2010; replacement cost profit was $23.9 billion compared with a loss of $4.9 billion in the previous year.

The hike in the quarterly dividend, to 8 cents per share, is the first increase since BP resumed paying dividends a year ago.

"The dividend is still far from the historical heady heights, however, whilst the ongoing fallout from the Gulf of Mexico spill is a distraction," said Richard Hunter, head of equities at Hargreaves Lansdown. "More positively, the fund put aside to finance these claims seems sufficient, whilst further planned divestments will enable BP to focus more strategically on higher growth opportunities."

BP shares were up 0.3 percent in early trading in London at 4.91 pounds.

"It was good to see a dividend increase with the results and it is a good sign of confidence in the improving operational performance," said Tony Shephard, analyst at Charles Stanley & Co., who rated the shares as "hold."

"BP's share valuation is low relative to the other oil and gas majors but it still faces uncertainty over the Gulf of Mexico tragedy."

BP faces its day in court in New Orleans on Feb. 27 with the opening of a limitation and liability trial over the spill.

BP PLC, rig owner Transocean Ltd. and cement contractor Halliburton Co. have been fighting each other over who was responsible for causing the blowout, which was finally halted in July 2010. U.S. investigators have said that BP bears ultimate responsibility for the spill, but has faulted all three companies to some degree.

"We continue to believe that BP will settle sooner rather than later given the U.S. presidential election and we see a 50 percent chance this will occur in the next few weeks," said Stuart Joyner, analyst at Investec Securities.

BP has reached settlements with some of its partners and contractors including $4 billion from Anadarko Petroleum Corp., which had a 25 percent stake in the well; $1.1 billion from MOEX, which had a 10 percent stake; and $75 million from Weatherford International Ltd. which supplied casing components.

"As I have said before, we are prepared to settle if we can do so on fair and reasonable terms, but equally, if this is not possible, we are preparing vigorously for trial," Dudley said.

BP says it currently has five deepwater rigs working on BP-operated fields in the Gulf of Mexico plus an appraisal well. It expects to have three more rigs working in the Gulf by the end of the year.

Here?s a daunting fact: Youths who age out of foster care are much more likely to drop out of school, wind up homeless, in jail or with an unintended pregnancy.

In 1998, about 17,300 youths in foster care nationally were on their own when they turned 18, according to the Dave Thomas Foundation for Adoption. That number grew to 28,000 in 2010.

Older teens need a ?forever? home as much as younger children, said Diana Tolstedt, a Wendy?s Wonderful Kids recruiter in Billings.

?I think before, people would say if they?re doing OK and they?re 16 and they?re in a foster home, just leave them until they age out,? Toldstedt said. ?Well, these kids, they?re 16 and they?re saying they want a family.?

Tolstedt has worked for Lutheran Social Services, a part of St. John?s Lutheran Ministries, since 2005. She?s spent half her time helping find families to adopt the older kids she works with, thanks to an initial grant from the Dave Thomas nonprofit.

The other half of her time has been focused on doing parent and adoption case work for Lutheran Social Services. Now, an additional $67,500 grant will allow Tolstedt to recruit full time, expanding her work from Billings to Eastern Montana.

Her work will take her north to Wolf Point, Glasgow and Havre, east to Sidney and Miles City and towns in southeastern Montana. That will double her caseload to 25 mostly 14- and 15-year-olds, and boost the number she?s actively recruiting for to about 15.

Building relationships

?A big part of the program is building a relationship with the social workers, who deal with the cases and the foster families, and who just don?t have time to do specific things with the kids in recruitment,? Tolstedt said.

She works with Child and Family Services of the Department of Health and Human Services for the state of Montana.

But Tolstedt also spends a lot of her time getting to know the kids, meeting with them at least once a month, and studying their case files so she can find a family who would be a good fit.

One misconception many people have about children in foster care is that they?ve done something wrong to wind up away from their own families.

?They?re only in care because their parents could not or would not care for them in the way that children should be cared for,? Toldstedt said. ?They haven?t done anything, and they didn?t enter foster care because something was wrong with them.?

But being passed from one foster family to another can tend to lower a child?s self-image. They also may develop behaviors or strategies to deal with the uncertainties of their lives.

That?s where finding the right family comes in, she said.

Sheila Howe, director of adoption services for Lutheran Social Services, said Tolstedt?s work can help older kids in foster care know that someone is on their side.

Working for them

?It lets them know that someone is really working for them to secure them a family, and that?s an important thing to happen to them and that they?re worthy of that,? Howe said.

Another misconception, Howe added, is that older kids aren?t interested in adoption. That might come, she said, from the idea that older teens tend to push away from their families in an attempt to gain their independence.

?But for many kids who are in the foster care system, in some ways they know so much more about the importance of family and what that means,? she said.

It means not having to move again, being able to go on vacation with their family, having someone to cheer for them at games or over a good grade. It also means someone?s there to hold their hand when they experience disappointment.

Tolstedt works to get out information on the youths she works with so prospective families can find them. That includes the television spots called ?A Waiting Child? and the Heart Gallery in Rimrock Mall, where their faces and their stories are on display.

She wants to do all she can to help them find homes they can call their own.

?No child is unadoptable,? Tolstedt said. ?They just haven?t been adopted.?

She has helped 22 children find permanent, loving homes. Now she can expand her efforts to help more of them.

Sandia Labs engineers create 'self-guided' bullet (AP)

ALBUQUERQUE, N.M. ? Figuring out how to pack a processor and other sophisticated equipment into a machine gun bullet has been a challenge, but engineers at Sandia National Laboratories say the miniature guidance system they've developed is a breakthrough.

A bullet that directs itself like a tiny guided missile and can hit a target more than a mile away has the potential to change the battlefield for soldiers without costing too much, engineers said Wednesday.

Sandia technical staff member Red Jones said the .50-caliber bullets are being designed to work with military machine guns, so soldiers could hit their mark faster and with precision.

"Everybody thought it was too difficult to make things small enough. We knew we could deal with that. The other thing was it was going to be too complicated and expensive," he said. "We came up with an innovative way around that to make it stupid and cheap and still pretty good."

Developing more precise weaponry has been a mission for government and industry scientists for decades. Most recently, the research arm of the U.S. Department of Defense has awarded tens of millions of dollars in contracts to companies to develop guided ammunition for snipers and special scopes that account for crosswinds and other environmental variables.

The idea behind Sandia Labs' bullet is rooted more in the M2, a belt-fed machine gun that became standard issue in the U.S. Army nearly 80 years ago. Pairing the M2 with the guided bullet would allow soldiers to hit their mark faster and with precision.

At 4 inches long and a half-inch in diameter, the bullet is designed to twist and turn, making up to 30 corrections per second.

Jones and his fellow researchers had initial success testing the design in computer simulations and in field tests of prototypes, built from commercially available parts.

With most of the hard science done, Jones said the next step is for Sandia to partner with a private company to complete testing of the prototype and bring a guided bullet to the marketplace.

More than $1 million in research and development grants have taken the project this far.

Computer simulations showed an unguided bullet under real-world conditions could miss a target more than a half mile away by nearly 10 yards. But according to the patent, a guided bullet would get within eight inches.

The design for the bullet includes an optical sensor to detect a laser beam on a target. The sensor sends information to guidance and control electronics that use an algorithm in an eight-bit central processing unit to command electromagnetic actuators. The actuators steer the fins that guide the bullet.

Jones said there are still some engineering problems to be sorted out that will make the bullet more practical ? for example, it will have to be tough enough to be dropped off the back of a truck and still work.

Even more innovation is needed for the manufacturing process.

"What we want to do is make it cheap enough to make it cost effective for the military to use in a machine gun," he said. "It's not going to be millions of dollars, but it's not going to be a buck a piece either."

The technology has captured the interest of weapons experts, both for the successful miniaturization of guidance systems that are usually reserved for missiles and for the potential benefits of precision.

"All of a sudden now you've got a way to eliminate the collateral damage issues. From that perspective, this starts to get interesting," said Adam Firestone, an Army veteran, instructor and a weapons system engineer.

Firestone and other experts said the battlefield of the future will surely include more capabilities for guiding bullets and bombs, but what will make the difference will be communication improvements and intelligence sharing systems that take advantage of the high-tech weapons while linking each soldier together.

Defense department researchers and contractors are already developing flying nano-bots that can stream live video, contact lenses that would allow soldiers to focus simultaneously on virtual digital images and their surroundings, and smartphone apps that help with tactical operations.

"Where we're going is to a world where the individual soldier, Marine, sailor or airman lives in a bath of knowledge. The world would be surreal in the original sense of super real. When you look at something, you see what you need to see when you need to see it," Firestone said. "They will have the ability to make decisions more accurately and that will have a significant impact."
